1. scope of application
any services, deliveries and offers of the beastin gmbh (beastin) are made exclusively on the basis of these terms, unless the parties explicitly come to a different agreement. authoritative is the relevant version at the time of the agreement.

2. contract conclusion
the presentation of the products in our online-shop does not imply a binding offer of beastin. it is a request to you to submit a binding offer to beastin. you can order by phone or by klicking the send-button in our online-shop regarding the products in your shopping basket. by ordering the desired products, you submit a binding offer for the conclusion of a contract. beastin will confirm the receipt of your order in form of a written note (e.g. fax or email). this confirmation does not stand for a binding acceptance of the order. the contract is concluded, when beastin formally delivers an order confirmation to you or sends the ordered products to you.

3. delivery service
for each order to a delivery address in germany, we will charge a flat shipping rate of € 5. this shipping rate is charged only once if an order is delivered in several parts. shipments abroad cost € 10 for austria, € 15 for switzerland, € 25 for usa and € 50 for all other countries. shipments outside the federal republic of germany will be made only against payment in advance or credit card. in case the ordered merchandise cannot be delivered in time or not at all, without beastin being responsible for, and although the contract has been concluded, beastin will inform you in due time. in such a case of delay you can either wait for the shipment of the merchandise or withdraw from the contract. if it is impossible to deliver the shipment, both beastin and you have the right to withdraw from the contract. in case of rescission beastin will reimburse any advance payments
made without delay.

4. payment service
all prices quoted include the legal vat. you can choose which way you would like to pay - by advance payment, credit card (master-/eurocard, visa, diner's) or cash on delivery. if you're ordering for the first time and with credit card, please send a scan of your photo id and a copy of the credit card to the following email-address: This e-mail address is being protected from spambots. You need JavaScript enabled to view it . all prices are quoted in the confirmation of the order and are due when the order is placed or delivered, respectively. the prices quoted in our catalogues and flyers are valid only until publication of the next catalogue or flyer. if you order from our website, the prices shown there on the order date are applicable.

5.right of revocation
you can revoke your contractual statement within one month without stating reasons in writing (e.g. letter, fax, email), or, when you got the merchandise before the expiration of the above time limit, by sending it back. the time limit starts with the receipt of this instruction in writing, but not before the merchandise has reached you as the receiver (in the case of recurring deliveries of similar products not before you received the first partial delivery) and also not before the fulfillment of our duty to inform in accordance to §
312 c abs. 2 bgb i.v.m. §1, 2 und 4 bgb - infov, also not before the fulfillment of our duties in accordance to § 312 e abs. 1 s.1 bgb i.v.m. §3 bgb info.

in order to not exceed the cancellation period the timely mailing of the revocation or the merchandise is sufficient. address the revocation to:

the right of withdrawal does not exist in the case of contracts concluded for the delivery of products especially manufactured for your own needs (e.g. jerseys with individual number prints).

consequences of revocation
in the case of an effective revocation, the mutually received benefits are to be returned and if so derived profits are to be returned. in case you are unable to reimburse us either in total or partially for services received, you are required to offer a compensation of equal value. this does not apply, when the deterioration of the merchandise has been checked like it is possible in a shop. has the merchandise been damaged through conventional usage, you do not have to pay compensation. any merchandise eligible for
shipping will be returned at our expense and risk. merchandise not eligible for shipping will be picked up at yours. duties for the compensation of payments must be fulfilled within 30 days. this time period begins for you with the posting of your rescission or the merchandise, for beastin with the reception of it.

6. warranty
the legal warranty is 2 years and begins when the merchandise is handed over. during that time we will remedy all defects subject to the legal warranty at no cost to you. please report such defects immediately to the delivery agent or beastin gmbh; obvious defects must be reported within 14 days from receipt of the merchandise. initially, you may claim rectification. if this fails, you may choose between rescission from the contract or reduction of the purchase price and damage compensation as far as permitted by law. please keep in mind, however, that normal wear is not covered by warranty. if any particular article cannot be delivered, we will send you a replacement which is equivalent with regard to quality and price. you may return this replacement article as already explained above.

7. set-off
you only have a right to set-off if your counter-claims have been validly established or are unquestionable.

8. right of rescission of beastin gmbh
in case of typing or printing errors and miscalculations on the website, in catalogues or flyers, beastin gmbh is entitled to rescission from contracts based on such errors.

9. reservation of ownership
beastin gmbh reserves ownership of any merchandise bought until the merchandise in question and all other articles from the same shipment have been paid for in full.

10. data protection
we will process personal data provided to us in connection with your order. we undertake to treat these data in confidence and not to pass them to third parties. unless we hear from you to the contrary, we will assume that you have no objection to receiving information for new beastin offers by post or e-mail.

11. language
this translation is just of indicative character. the contractual language remains german.

12. jurisdiction
as far as admissible, the court in munich shall have jurisdiction for all disputes.

13. applicable law
german law is applicable exclusively, unsales law being ruled out. the application of mandatory norms of the state, where the client has his residence at the time of the conclusion of the contract, remain unaffected of this choice of law. if any one of the above provisions should be or become invalid, it is to be replaced with a corresponding text, which is valid and equivalent to the intended meaning. the rest of the agreement shall remain unaffected and valid.
